MANAGUA – NICARAGUA / La Bancada Parlamentaria de Nicaragua se Pronuncia ante la crisis que enfrenta el Sistema de Integración Centroamericana (SICA), causada por la negativa persistente de ciertos países de la región a reconocer el legítimo derecho de Nicaragua a ocupar la Secretaría General del SICA, que corresponde por derecho e institucionalidad del Sistema, al pueblo y gobierno de Nicaragua.

PRONUNCIAMIENTO
Ante la crisis que enfrenta el Sistema de la Integración Centroamericana (SICA), causada por la negativa persistente de ciertos países de la región a reconocer el legítimo derecho de Nicaragua a ocupar la Secretaría General del SICA, que corresponde por derecho e institucionalidad del Sistema, al pueblo y gobierno de Nicaragua, «sin alcanzar consenso por las posiciones arbitrarias e infundadas de algunas delegaciones, Costa Rica, Guatemala, Panamá y República Dominicana» que ha sido un obstáculo para el avance del proceso de la integración.
Asimismo, la denuncia presentada por la República de Nicaragua al Estatuto de la Corte Centroamericana de Justicia se fundamenta en el Derecho Comunitario Centroamericano y en la Convención de Viena sobre el Derecho de los Tratados. Como expresó el Gobierno de Nicaragua en su comunicación al Presidente en Funciones de la Corte, Dr. Ernesto Salazar Grande, «desde hace 32 años, la Corte Centroamericana de Justicia ha operado con magistrados exclusivamente de El Salvador, Honduras y Nicaragua, sin cumplir con los propósitos originales de su creación como órgano judicial de carácter regional».
Esta situación contradice los principios de integración regional, impidiendo el desarrollo de una Corte que representa verdaderamente a todos los Estados miembros del SICA en condiciones de igualdad, con pleno ejercicio de sus derechos y obligaciones. Nicaragua considera esta circunstancia como insostenible e inaceptable, «ya que esta Corte está sometida a las decisiones del Consejo Judicial Centroamericano y del Caribe, que no forma parte del Sistema de la Integración Centroamericana (SICA), así como a decisiones de países que, a pesar de haber aprobado el Estatuto, no han materializado su voluntad de integrarse a la Corte Centroamericana de Justicia oa países que no forman parte del Estatuto».
Por tanto, manifestamos que:
Primero: Respaldamos la posición del pueblo y Gobierno de Nicaragua, que en su comunicado sobre el SICA Ilamó a los gobiernos de la región «a asumir una posición responsable, fundamentada en la normativa regional y los acuerdos presidenciales que rigen el Sistema de Integración». Además, enfatizamos que Nicaragua no cesará en su lucha por el respeto a su soberanía y dignidad nacional.
Segundo: Consideramos urgente avanzar hacia una integración más sólida, dejando atrás posturas que debilitan la unidad regional. Es hora de superar la modalidad de «integración a la carta» y trabajar decididamente hacia la formación de una auténtica Comunidad de Naciones.
Tercero: Nicaragua ha sido uno de los países que más ha aportado al proceso del sistema y de la integración centroamericana, a pesar de que fue conformado en el año de 1992, hasta el día de hoy el sistema no está completamente conformado, los únicos países que realmente están presentes en casi todas las instancias son Nicaragua, El Salvador y Honduras, los demás países como Costa Rica, Guatemala, Panamá, República Dominicana y Belice no han asumido su pleno compromiso con la integración. Que Nicaragua siempre ha cumplido con sus aportaciones financieras en tiempo y forma
Cuarto: Respaldamos la decisión del pueblo y Gobierno de Nicaragua la decisión soberana e irrevocable decisión de denunciar el Convenio del Estatuto de esa Corte Centroamericana de Justicia, junto a los argumentos soberanos debidamente planteados por nuestro gobierno.
Quinto: Hacemos nuestro el llamado del pueblo y Gobierno de Nicaragua a los gobiernos de la región que asumen una posición responsable y actuar sobre la base de la Normativa Regional y Acuerdos de la Reunión de Jefes de Estado y de Gobierno del SICA, asumiendo de nuevo el espíritu de los Acuerdos de Esquipulas y concordante con los intereses de nuestros pueblos.
Sexto: La Bancada Parlamentaria de Nicaragua ante el Parlamento Centroamericano junto a su pueblo, con el espíritu vivo latinoamericanista del General de Hombres Libres, Augusto César Sandino, no declinará en su lucha por el respeto a su Soberanía y Dignidad Nacional.

PRONOUNCEMENT
Faced with the crisis facing the Central American Integration System (SICA), caused by the persistent refusal of certain countries in the region to recognize Nicaragua’s legitimate right to take up the General Secretariat of SICA which corresponds by right and the System’s own institutionality to the people and government of Nicaragua, «without arriving at consensus due to the arbitrary and baseless positions of some delegations, Costa Rica, Guatemala, Panama and the Dominican Republic» that has been an obstacle to the progress of the integration process.
Likewise, the complaint filed by the Republic of Nicaragua against the Statute of the Central American Court of Justice is based on Central American Community Law and the Vienna Convention on the Law of Treaties. As the Government of Nicaragua expressed in its communication to the Acting President of the Court, Dr. Ernesto Salazar Grande, «For 32 years, the Central American Court of Justice has operated with judges exclusively from El Salvador, Honduras and Nicaragua, without fulfilling the original purposes of its creation as a regional judicial organ.»
This situation contradicts the principles of regional integration, preventing the development of a Court that truly represents all SICA member States on equal terms, with full exercise of their rights and obligations. Nicaragua considers this circumstance as unsustainable and unacceptable, «since this Court is subject to the decisions of the Central American and Caribbean Judicial Council, which is not part of the Central American Integration System (SICA), as well as to decisions of countries that, despite having approved the Statute, have not put into effect their will to join the Central American Court of Justice, or countries that are not part of the Statute.»
Therefore, we declare that:
First: We support the position of the people and Government of Nicaragua, which in its communiqué in relation to SICA called on the governments of the region «to assume a responsible position, based on regional regulations and presidential agreements governing the Integration System.» In addition, we emphasize that Nicaragua will not cease in its struggle for respect for its sovereignty and national dignity.
Secondly, we consider it urgent to move towards a more solid integration, leaving behind positions that weaken regional unity. It is time to overcome the mode of «a la carte integration» and work decisively towards the formation of a genuine Community of Nations.
Thirdly, Nicaragua has been one of the countries that has contributed the most to the process of the Central American system and integration, despite the fact that it was formed in 1992, to this day the system is not completely formed, the only countries that are really present in almost all instances are Nicaragua, El Salvador and Honduras, the other countries such as Costa Rica, Guatemala, Panama, the Dominican Republic and Belize have not assumed their full commitment to integration. Fourth: We support the decision of the people and Government of Nicaragua, the sovereign and irrevocable decision to denounce the Convention of the Statute of that Central American Court of Justice, together with the sovereign arguments duly raised by our government.
Fifth: We make our own the call of the people and Government of Nicaragua to the governments of the region that assume a responsible position and act on the basis of the Regional Regulations and Agreements of the Meeting of Heads of State and Government of the SICA, assuming again the spirit of the Esquipulas Agreements and concordant with the interests of our peoples.
Sixth: The Nicaraguan Parliamentary Caucus before the Central American Parliament, together with its people, with the living Latin Americanist spirit of the General of Free Men, Augusto César Sandino, will not decline in its struggle for respect for its Sovereignty and National Dignity.
